DCP guidance for entering square footage, bedrooms and bathrooms on listings

As part of the Department of Consumer Protection’s mission to protect consumers, we are reminding licensees of the importance of accuracy and transparency in advertising. Marketing that contains misleading or confusing information — whether it is intentional or a mistake — may be considered a violation of the Connecticut Unfair Trade Practices Act (CUTPA).

One common issue is the reporting of “Total Square Footage” in property listings and marketing material. Including non-livable or below-grade space in the total square footage without clearly and prominently distinguishing it can be deceptive. You should carefully review listing and marketing information to ensure that square footage entries are clearly labeled to avoid the dissemination of misleading or deceptive information.

We recommend that listings reflect what is on record with the local assessor, including the number of bedrooms and bathrooms. Sellers who believe there are discrepancies should work with the assessor to correct the information on record, or explain in listing comments why they believe the assessor records are incorrect.
